Terms of Service

1. Acceptance of terms

By accessing or using Dial A Deal's website or its web or telephone buying services (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. The Service & our role

Dial A Deal is an independent buying service. Acting as your buying agent, we search eBay, accept payment from you, and purchase items you approve on your behalf, then arrange delivery and provide after-purchase support. We are not the manufacturer or original seller of the items, and we are not a marketplace.

3. eBay's role & sellers

Items are listed and sold by third-party sellers on eBay. Listings, inventory, pricing, fulfilment, returns, and buyer protection are provided by eBay and its sellers and are governed by eBay's own terms and policies (including the eBay Money Back Guarantee where applicable). Dial A Deal is not affiliated with, endorsed by, or sponsored by eBay Inc.

4. Your request, confirmation & authorization

When you ask us to buy an item, we will present the specific item, seller, shipping, taxes, our service fee, and the full total. We will charge your payment method and place the order only after you explicitly confirm — by action on the web or by spoken approval on the phone. You authorize Dial A Deal to purchase the confirmed item on your behalf and to charge the confirmed total to your payment method. You are responsible for orders you confirm.

5. Payments, fees & pricing

You pay Dial A Deal the item price plus any applicable shipping and taxes and a Dial A Deal service fee, all shown to you before you confirm. Card payments are processed by a PCI DSS compliant provider; we do not store your full card number. Prices, availability, shipping, and taxes are set by eBay and its sellers and may change before an order is completed; if the price changes materially, we will re-confirm with you. 6. Delivery

Items are shipped by the eBay seller to the delivery address you provide. Delivery times are estimates set by the seller/carrier. Please give an accurate address; we are not responsible for delays or losses caused by incorrect details you provide.

7. Returns, refunds & cancellations

Return and refund eligibility follows eBay's and the seller's policies. On your behalf we will request returns, arrange labels where available, and progress refunds; approved refunds are returned to your original payment method. Where we have already incurred non-recoverable costs, our service fee may be retained as described in Section 5. We will tell you what applies to your specific order. See Order help.

8. Eligibility & your responsibilities

You must be at least 18 (or the age of majority where you live) and able to form a binding contract. You agree to provide accurate information and to use the Service only for lawful purposes and for items you may lawfully purchase and import to your location.

9. Acceptable use

• Do not use the Service for any unlawful, fraudulent, or infringing purpose, or to purchase prohibited or restricted items.
• Do not provide payment methods you are not authorized to use.
• Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service, our processor, or eBay.
• Do not use the Service to violate eBay's policies or any applicable law.

10. Phone channel & recordings

If you use the phone channel, you consent to the call being recorded and/or transcribed for the purposes described in our Privacy Policy, including capturing your purchase approval. Card details entered on the keypad are masked and excluded from recordings. If you do not consent to recording, please use the web channel.

11. Intellectual property

The Dial A Deal name, site, and software are owned by us or our licensors. "eBay" and related marks are trademarks of eBay Inc., referenced only to describe interoperability. We grant you a limited, revocable, non-transferable license to use the Service per these Terms.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that listings, prices, or availability are accurate or that the Service will be uninterrupted or error-free. Items are sold by eBay sellers, and product warranties (if any) are provided by those sellers or manufacturers, not by Dial A Deal.

13. Limitation of liability

To the maximum extent permitted by law, Dial A Deal and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to a given order is limited to the amount of the service fee you paid us for that order; for claims not related to a specific order, to USD 100. Nothing limits liability that cannot be limited by law, including for fraud or willful misconduct.

14. Indemnification

You agree to indemnify and hold harmless Dial A Deal and its operators from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your provision of inaccurate information, or your violation of these Terms or applicable law.

15. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service, our customers, sellers, or eBay. Sections that by nature should survive termination will survive.

16. Governing law & disputes

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws rules. The state and federal courts located in Rockland County, New York will have exclusive jurisdiction, unless mandatory consumer-protection laws provide otherwise.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date and, where appropriate, notified to you. Continued use after changes means you accept the updated Terms.
